THE US OPEN TENNIS

I’m certain that you know Djokovic has been prevented from competing in the US Open the last major of the year. This is total nonsense. Now I don’t dislike Raphael Nadal but he is the greatest clay court player in history but he is not the greatest tennis player in history. That’s Djokovic who entered the year tied with Nadal and Federer at twenty majors but has been prevented from competing in two of the four majors because of the covid natzis. And Nadal won two of them and only one that he would have won if Djokovic was in the field. So I think his number should carry an asterisk because his major remaining rival was prevented from competing not because he was injured or otherwise incapable of competing but because he got Covid and has natural immunity and refused to get the shot which has now been shown to not only be ineffective but dangerous. I hope that someone knocks off Nadal.

QUICKIE

It appears that cocaine Mitch got the message and now is going to campaign and give money to get Herschel Walker across the finish line. Now I believe that he knows these candidates are going to win with or without his help and they could easily kick his ass to the curb and so like McCarthy he’s trying to pretend he’s not the slug he is. Don’t believe it for a minute.

OBSERVATION

I’m pretty sure that all of you are thinking the same thing as I am but I don’t see anyone really talking about it so I will. Is there anyone reading this that has any faith that we will ever know what was seized. The feds have had the documents for going on three weeks and we have no way of knowing what they actually took. The magistrate apparently asked for a detailed inventory but he didn’t supervise and has no way of knowing how accurate it was. We know Trump’s passports and Melania’s panties weren’t listed.

And does anyone truly believe that the special group in the FBI that was supposed to review the documents to make sure nothing improper was seized are independent and wouldn’t bury anything management wanted?

And now another Magoo moron the DNI is going to go through them to do a damage assessment.

Ok here’s the thing that really concerns is that one of the papers had a quote that the feds didn’t find what they were looking for. How can that be since they reviewed all the documents back in June. Here’s my take they want to use this to get another warrant but more likely they found what they wanted — documents on the Russian hoax and other coverups of DOJ and FBI illegal actions that Trump declassified and wanted to be made public — and by saying they didn’t find them allows them to bury them forever. They will never see the national archives or anywhere else. Opportunity to bury their crimes forever.

JUST TO END THE NONSENSE

Just to end the nonsense about Hillary’s declassification authority because even people who should know better don’t. On Friday Buck Sexton who apparently was a classification officer in the CIA said she didn’t have declassification authority and Bongino continues this falsehood even today and so I decided to once and for all I am attaching E.O. 11652. I tried to just download the pertinent sections but couldn’t so the whole thing is here but just skip down to section two where you will see who has original classification authority and you will find that the Secretary of State listed.

And then skip to section three and you will see that she had the authority to declassify anything she classified or anything classified by a subordinate.

And you might ask why I chose that E O and it’s just the one that I remembered the number for, but I guarantee it has been amended many times but the basic first two sections are basically the same. As a quick example this order referred to the Atomic Energy Commission and then had to be amended to replace AEC with NRC and ERDA and then again when DOE came into being and ERDA vanished. Listen every president puts out a new order tweaking the previous one but the basics don’t change.

MAYBE MY BAD

So I said that I agreed with Dershowitz on whether the warrant should have been granted because of the allegations that the highest levels of classified information was in the mansion, but what I forgot about was that the warrant basically was what’s known as a general warrant which is unconstitutional. One of the things that our founders wanted to prohibit was the use of a general warrant to allow the king’s people to just get a warrant to allow them without specificity of what the supposed crime was and what they were looking for and just ransack your house to see if they could find some reason to charge you and that’s why they put in the fourth amendment that warrants could only be issued naming the potential crimes and specifically specifying what exactly they are seeking. In Trump’s case they sought any documents that might have been created during his administration and that is the definition of an unconstitutional general warrant.

My bad. And Dershowitz should know better.

UPCOMING CONUNDRUM

I assume that most of you know that the Dems asked their friends in the ‘intelligence’ community to do an assessment of the damage Trump caused to our national security by having the documents stored at his mansion. Btw I don’t recall there being a similar assessment done with respect to Hillary’s bath tub server which we know was hacked by just about everyone.

Here’s where the conundrum comes in. You know they want to write some drivel about we were only minutes away from the total destruction of the country and they might because they think they can get away with anything and maybe bring back the 51 intelligence experts who said that Hunter’s laptop was Russian disinformation.

But on the other hand, they know that even in leftist sources they recognize that the feds waited 18 months to get the docs and waited two months after they reviewed the docs to execute the raid and Garland waited several weeks before approving the warrant application and then they waited three days after the warrant was issued to execute it. That means that it wasn’t an urgent matter and to say otherwise would implicate DOJ and the FBI in impairing our national security.

This is going to be interesting to watch.

ADD ON

Just in case you don’t know, the Presidential Records Act didn’t come into effect until after Nixon. Previously presidents were free to do whatever they wanted with their records and it’s unclear whether the act itself is constitutional. Based on the one non precedential district court case the answer is no. And just to be clear you could cite that case as precedent but everyone could ignore it.

THE AFFIDAVIT

This is probably going to be long so pour yourself a big one, sit back and relax.

The first thing I will say is that I didn’t read the redacted affidavit because I knew what it would be. ( And as an aside and I have thought about doing this for a while, do you know where the present day familiarity and obsession with redact, redacted, and redaction came from? It was virtually unknown to anyone until either the first or second major Supreme Court decision on the FOIA used it extensively and everyone, including me had to look it up and I was responsible for FOIA at the time, and basically it was a synonym for edit at the time. Btw I have no idea what it would be called now. Back in my day it was synonym and homonym and antonym but that’s no longer the case because I watch quiz shows and the terms have changed.)

Sorry for the digression. I agree with Dershowitz that any magistrate or judge would have issued the warrant because all the allegations were that Trump had the highest levels of classified information at his mansion and I knew that it would not contain any information that Trump said he declassified them, although I have to question putting in that according to I think CBS Miami they saw u-hauls at the mansion. ( I’m using mansion because the actual name is a pain in the ass to hunt and peck on my iPad.) And the Trump camp said the opposite.

And before I go further I want to point out that there has been more nonsense about Magoo being ignorant. Well that’s of course true, but about the raid. Listen, Magoo is a low IQ, thin skinned, narcissistic bully who has used his position against enemies in the past and it has been reported in the last couple of weeks Magoo asked Garland why he hasn’t arrested Trump. Dog faced pony soldier and fat come to mind and don’t forget calling Peter Doocy a stupid son of a bitch.

Now getting down to business, the reason or inspiration for this rant came from one of you who asked if I thought Trump was in trouble and I said no he said he declassified everything and that’s it. And he asked could he even do that with the top secret stuff and I said yes and thanked him because he gave me the idea for this rant.

Okay I have said this so many times in so many contexts that I would think you know it by now but apparently some haven’t comprehended it so I will do it again with reference to previous things. Under the constitution all executive branch power and authority is vested in the president period. The administrative/deep state doesn’t have any authority on its own. It’s all derived from the president. However the deep state thinks otherwise and that’s why they are so opposed to Trump. He was asserting his dominance and they didn’t like it. So let me review a couple things I have discussed before. The first impeachment was basically the weeble known as Vindman claiming that Trump was not following US foreign policy and as I and the constitution make clear, the president is the sole arbiter of what our foreign policy is. If you don’t like it get your dumb fat ignorant ass out. You don’t get to override the president you self important idiot.

Likewise with all the nonsense about DOJ and the FBI are independent is total and complete bs. They are in the executive branch and subordinate to the president and he can require them to do whatever he wants. Presidents have ordered them to arrest and prosecute opponents and I’m not going to go through it again, it’s in previous rants.

Which gets me back to today’s subject and it’s an exact parallel to Vindman. Some people think they can overrule their boss. Once the president says something is declassified it’s declassified. None of these deep state subordinates can change that or claim he didn’t follow some procedures they set up. They derive any power they have from him and he can just say kiss my ass serfs. I’m the king and you’re not.

JESSE

Am watching Jesse and he had on a guest talking about the FBI potentially having bugged Mar a Lago and I thought that was nonsense because there is no way it’s not protected by people and their video system. He indicated that the FBI could plant undetectable bugs and maybe that’s true. I have absolutely no knowledge that would suggest otherwise, but I have to believe that if anyone has the resources to thwart this it’s Trump and his security and video system. So I don’t believe that they infiltrated his home to plant bugs. And I don’t think they would even try for fear of being caught.

However it occurred to me that they could have gotten, it’s entirely possible that they did access to his own video system. That’s why I don’t have cameras inside my house as part of my security system. Remember that the ring doorbell system has been infiltrated and let others see what is happening in your house. And since I saw again today that the feds admitted that they were watching what was happening before the raid, I think that they may well have done that. As I said, if Trump gave them access to cameras covering the basement, he would never have done anything questionable with the cameras on.

Lastly Jesse’s guest postulated about nuclear football and other stuff and Jesse said you’re speculating, he didn’t ask him if Trump declassified it. I expect that from the left but not from the right. Trump could declassify anything and everything period.

BONGINO

I didn’t do this yesterday because I guess I was in a good mood and like Bongino, but he said two things that were utterly ridiculous. First he was trying to give an example of reckless disregard of protecting highly sensitive classified information and used as an example an agent in Russia who had Russian nuclear secrets and left them in his hotel room and they got stolen by Russia. There is absolutely no way an secret service agent could ever have that material in his hotel room unless he stole it. That’s just impossible. You can’t have that level of information in your hotel room period.

The second is that when comparing Trump and Hillary his side kick Jim said and she didn’t have declassification authority. Totally false. If you look up the executive orders controlling classification you will see that the president delegates to various cabinet officials and others classification authority and it always includes the Secretary of State. And then these individuals can delegate their authority down the line but Hillary was the top classification authority in the State Department. She could classify or declassify any documents solely in State. The difference between her and Trump is that she couldn’t declassify documents classified by other agencies. Trump could declassify anything because he was president.
