He just said something that was totally wrong. He said that DOJ planned to arrest Chauvin on federal charges if the jury acquitted him. And then he said that would violate double jeopardy. First, the story appears to be true and I’ve recently seen that the feds plan to charge him with federal civil rights violations.

Most importantly, Tucker was wrong on the double jeopardy. It is not a violation for separate jurisdictions to try someone on the same basic charge. Usually one or the other jurisdiction steps aside to let the other proceed, but they don’t have to. The feds can charge you with a violation of federal law and the state can charge you with a violation of state law.
