Last week Andy McCarthy put out an article saying that the Dems had a big advantage because they got to go first and he always thought that that was a big advantage to get his case out first before the jury. With all do respect to Andy, I disagree. He is talking about opening statements. What we are really dealing with are closing statements.
in a normal case the party with the burden of proof gets to to make the first closing statement and then the other party gets to make their closing statement. But here’s where Andy is wrong. In a normal case the prosecution gets to make a response to the defense closing statement. That’s not the case here. The Dems made their case or the lack there of and now the president gets to make his case and the Dems don’t get to respond. They are stuck with their baseless case and the president’s team get to rip it apart without rebuttal. Sorry Andy but your being only aware of criminal procedure is causing you to get this process wrong. I have litigated many cases where you only get one bite of the apple and it’s always better to get the last bite!
