The fact that most government departments and agencies have money appropriated for a specific fiscal year is the reason you see them trying to push out all kinds of ridiculous last minute spending every September. If they don’t get it out, they lose it. And a similar thing is happening now because when Trump ousts Magoo, Trump’s cabinet won’t approve the bogus spending.

And I’m glad. They tried to pull the same bs they do every year and put up a pork laden funding bill at the last minute under the guise of avoiding a government shutdown. Fortunately there is a new sheriff in town and he and his posse aren’t going to play by the rules of the swamp.

As soon as this crap bill, all 1500+ pages of it, were released, Trump and Elon and Vivek made it clear that the bill was unacceptable and that any Republican who voted for it would be primaried, suddenly the bill got pulled. We finally have an incoming administration that isn’t part of the swamp and is more than willing to play hardball. And fortunately the swamp rats know that they mean what they say.

I don’t know what will happen now but if it takes a government shutdown to eliminate all the pork, most of which is Dems wish lists, so be it. As we’ve learned in the past, most of us will not even notice that it happens. Social security checks will still go out along with Medicare benefits and government pensions and the military will still be on duty. The federal employees will eventually get paid and most of them won’t be working anyway. The one good thing that used to come out of a shutdown was a decrease in traffic but since most federal employees aren’t going into the office now, that benefit won’t occur. (BTW my agency had what’s called no year money, meaning that we didn’t have to spend every penny appropriated by the end of the fiscal year for which it was allocated. We always had leftover money that would carry us for several months, and it was even crazier in the latter part of my tenure because we got our money from fees on licensees and not from the Treasury.)

And I think that in the present day where most people get their news from outlets other than the mainstream media, the blame will be placed on the Dems. The majority of the country voted for Trump and against this constant waste and fraud in the federal government and we won’t blame Trump for doing what we elected him to do. I believe that the Dems are way out over their skis and refusing to accept that they just got their asses handed to them, but they will learn.

UNC lost to my undefeated Gators tonight but they are the first team this year to lose by less than 13 points. And the game was basically a home game for UNC because it was played in Charlotte.

Great to have SK back. Does anyone know WTF that means? The word salad cackler is back. Apparently after Magoo endorsed her yesterday, she thinks she’s back and going to run for president again. Please let that happen!

I have ranted about this several times before but since it has become obvious that most of you don’t remember anything I write for more than a few weeks I will refresh your recollection because it bears on the ABC and Stephanopoulos $16 million settlement for defamation of Trump.

The Sullivan case established the principle that the press cannot be held accountable for defamation unless you can prove that not only did they know or should have known that what you published was false but that they did it with malice intending to defame you.

I have ranted previously about the fact that when I was at Harvard, Sydney Pollock played his film, Absence of Malice, for us for our reaction before it was released. Btw it’s a great movie starring Paul Newman and Sally Fields and you should watch it if you can.

Now as I have ranted previously about the Nick Sandman and maybe other cases that the msm is scared to death that a case will make it to the Supreme Court that will give the court the chance to review the Sullivan decision because that decision is clearly contrary to the constitution.. Justice Thomas has been an outspoken critic of that decision for years and now Justice Gorsuch has joined the fight. There is absolutely nothing in the Constitution that says that the press is to be held to a different standard than everyone else on defamation, and the msm doing everything possible to keep the case from ever reaching the Supreme Court because it would destroy their privilege to defame public figures.

BTW I should have mentioned that the malice standard only applies to public figures. Private people can sue when false information is published without regard to malice.

Today there was another school shooting and this time it wasn’t covered 24/7 like it usually is. I hope that this is a realization that if you don’t have anything new to report as I have been ranting about for years then get back to regular programming. However there is the possibility that because they couldn’t spin it politically. I saw today that on I think December 4th there was a school shooting in Southern California and it wasn’t reported on at all because it wouldn’t forward the narrative that the news prefers.

On Levin tonight he doubled down on my position on the 14th amendment and birthright citizenship. And as always he did a deeper dive and so I hope you saw it. In any event, he confirmed that what I told you was right. The only thing different in his view is that even in the case of the Chinese case I talked about where he was born to legally resident parents living here, he was not a citizen under the amendment. He didn’t really explain that but if he thinks so then there is serious legal support.

I have seen that DOGE wants to get away from cost plus contracting in the federal government. What is that you ask? A contract where you get paid for all your legitimate costs plus a profit based on a percentage of your costs. They are common in the federal government and actually encourage companies to inflate their costs because it will increase their profits.

I can give you one example from my days in the swamp. I was, due to my position as the Assistant General Counsel responsible for contracts, the legal person on a committee that had to review and approve all major contracts in the agency. On one occasion and I don’t remember the specifics but it had to do with upgrading something on nuclear power plants. Anyway during the course of the discussion it became clear that most of the work would be done in the first year of the contract and I asked if that is true then why is the payout under this contract a geometric progression and it surprised them that I asked the obvious.

Now if you don’t know what a geometric progression is, it’s a series that goes up by a given factor every year. For example if some service costs two million in year one and then four million in year two and then eight million in year three etc that is a geometric progression. The price doubles every year.

The result was they had to scale down payments in outer years.

And it reminded me of another committee I was on dealing with major rule making. We took a trip to Paducah, Kentucky to visit a Uranium enrichment facility and as part of that trip we also visited a facility across the Ohio river in Metropolis, Indiana dealing with uranium hexaflouride. Btw they have a large Superman statue in the town square. However, the thing I want to mention is that on the day we visited the temperature was 102! Inside the plant we put on appropriate clothing and the temperature at the top level was 132. My point is that we got out and in just our regular clothes, 102 felt like taking a cold shower. Everything is relative.

I saw an article today talking about waiters and bartenders etc planning on fighting the Trump administration by refusing to serve or slow rolling Trump officials in restaurants in the DC area. Now this is particularly stupid for several reasons. First even Mayor Bowser, who I always confuse with the guy on Sha Na Na, has been begging Trump to bring back the federal workforce to actually work in their DC offices because their absence has severely affected DC businesses from coffee shops to sandwich shops and restaurants and even dry cleaners. And so why would these idiots want to discourage what would be a boon to them? And I just saw on Jesse that unsurprisingly Republicans tip much better and demand much less in terms of service than Democrats.

And lastly, Trump is going to give them a huge raise by making tips tax free. Why bite the hand that feeds you?

My one concern is how the Supremes will address the issue of the hundreds of thousands or millions of illegals who are now citizens under a false reading of the Constitution. Will they leave them as citizens or retroactively revoke their citizenship? I don’t have a clue.
