Now a couple of you have seen this but to be fair I must admit that surgeons have similar concentration requirements, particularly brain and heart surgeons because those operations frequently last for hours. If you can think of anyone else please feel free to enlighten us with a comment.

Just so you know that I’m not being overly harsh on this idiot in Kenosha, Chief Justice Warren Berger once said that 95% of trial lawyers were bad at their job and I think he was being generous. But that’s no excuse for not knowing what your own witness is going to say!

Now let me tell you what it really takes to be a good litigator. Obviously intelligence but more importantly the ability to concentrate 100% for 7 or 8 hours a day. Those of you who read this and are still working, ask yourself how many hours a day at work you are actually concentrating totally and completely on what you are doing 100%. I’ll be generous and give you one hour and that is generous. If your in a trial you have to be able to do it all day. If it’s your witness you have to ask the questions and be able to ask follow up questions to make sure you get the information you need from your witness. I always told my witnesses when we went over their testimony not to worry, if they forgot something I would ask questions to make sure we got it all right. You also had to be ready to respond to objections from the other side.

When the opposing side had a witness you have to be prepared to object to a question instantaneously before the witness answered while simultaneously taking notes for cross examination. It’s total concentration and there’s not a lot of people who can really do it. Most attorneys have a prepared set of questions and don’t really pay attention to what was said before going on to their next prepared question.

But that still doesn’t excuse not knowing what your own witness will say!

The prosecution in this politically motivated trial that should never have been brought is totally imploding. To be honest, he’s an idiot who should never see the inside of a courtroom again unless it’s to testify at the trial brought by Rittenhouse for malicious prosecution. He has called I think now three supposed witnesses for the prosecution who have made the case for Rittenhouse and self defense. And he has shown video that clearly shows that Rittenhouse was not the instigator but defended himself.

Now the article I had wanted to link had a brief clip in which the prosecutor engaged in the cardinal sin taught in any litigation course — namely asking a question you don’t know the answer to. He asked a witness who he had called after getting destroyed by the witnesses testimony how he could know what the guy Rittenhouse shot was thinking. How could he know and the witness said because he said fuck you and then lunged for Rittenhouse’s rifle. He couldn’t recover from that and I’m not going to go into all the exculpatory evidence withheld from his attorney but that will be key in a malicious prosecution case.

No what I want to talk about is just how stupid this idiot is. These were his witnesses. He undoubtedly interviewed them and should have prepared their testimony. There should have been no surprise answers to his questions but there were many.

Now I agree with the adage that you never ask a question you don’t know the answer to in a criminal case or even in a civil case where you’ve had full discovery and an opportunity for depositions and interrogatories, but you need to understand that is maybe five percent of the litigation in this country. Most is administrative litigation in a myriad of forums under everything from trial by ambush under the rules of gossip to fairly formal trials in front of Administrative Law Judges with full discovery and I guarantee you that if I had followed the adage I wouldn’t have been as overwhelming successful as I was.

I used to attend the American Bar Association conference every year and went to various presentations from the Litigation Section of which I was a member and also to various presentations from the Labor Law Section and it was clear that the labor attorneys were better. The Litigation Section only dealt with courtroom litigation, as I’ve said a minor part of the cases in this country, those attorneys are spoiled because they get to know pretty much everything thing before trial. The labor guys have to think on their feet and react to information as it comes out.

Again this idiot should never see a courtroom again. How can you call a prosecution witness and not know what he’s going to say. That’s malpractice! And I believe that Rittenhouse will be acquitted and hopefully sue these idiots.

I have been telling you for more than a year that the Covid-19 numbers are phony and incredibly inflated to scare the shit out of you and make you follow ridiculous reductions in your freedom and no doubt enriching the ruling elite via big pharma. Someone needs to take a deep dive into just how much politicians are getting and how they are hiding it. Ditto for Fauci.

First, in case you missed it, although I don’t know how you could, the New Jersey truck driver who spent $153.00 on his campaign just beat the Dem president of the NJ senate in a shocking upset. A true life Cinderella story.

The other thing which I meant to put in yesterday’s rant is that once again we saw the fallacy of early voting. I have no problem with a ten day window for voting so that you don’t have to stand in line for hours but I would also require that no mail in ballots be accepted if they are postmarked earlier than that ten period. The reason is simple. People who voted in September were unaware of a lot of things that came out in the last month before the election – – like mcauliffe saying parents have no right to decide what their kids should be taught and the coverup of the rape of a girl in the girls bathroom by a boy wearing a skirt. It is clear that had those early voters known those things, Youngkin would have won by a much larger margin. And similarly had early voters in NJ known that Murphy planned to impose a vaccine mandate if he was re-elected, it’s quite likely that he would have lost.

Last night was a total rejection of wokeism. In Virginia Republicans won not only the top three state wide offices but apparently flipped the legislature as well. And the Republicans flipped a state house seat in San Antonio in a district that is 75% Hispanic.

In New Jersey, as you know, it’s still too close to call which is incredible in a state Biden won by 16 or 20 points. I’m sure that Murphy will survive because there are a lot of absentee ballots left to count and you know how that goes blue states.

Several school boards were flipped including one in Colorado!

Congressional Republicans today called Pelosi Galore a lame duck.

What did the left learn? Absolutely nothing! They blamed it on racism even though Virginians elected the first black and the first Hispanic to statewide office. They claimed that they lost because they didn’t pass their socialist agenda which the country overwhelmingly rejects. I could go on and on about their endless bogus excuses, but let’s face it, nobody likes their policies. And ironically, while it allowed them to slip a zombie into the White House, COVID-19 also was their downfall because it forced parents to actually see the garbage their kids were being taught and it sparked a grassroots revolution.

Now, in spite of Pelosi’s statement that nothing changed and she would push forward with her radical bills, she knows they are dead in the water. She doesn’t have the votes, if she ever did. As I said previously, there are at least 30-40 Dems who are moderate in the house and they are not going trash their re-election chances by marching off a cliff for AOC and her ilk. And the Republicans in the house to cement that announced that were targeting an additional 13 Dems in next year’s election. And Manchin and Sinema are not going to feel the need cave to a rejected agenda. I predict that several Dems in the house will now decide not to run for re-election.

Come on 2022 and let’s take out the trash.

Saw that Fox was the last media outlet to declare Youngkin the winner in Virginia. They had no problem making a premature call for Biden but not for Youngkin. That was no accident. Fox News management is solid left and willing to do anything that isn’t too overt to help the left.

Saw an article today that said that the sodomy which I talked about was in fact anal. According to the rapist’ mother, unbelievably she was blaming the victim and her son’s uncontrollable teenage hormones, said he wanted to have vaginal sex but missed and went in the wrong hole for about ten seconds. Clearly this is a very poor excuse for a mother.

A favorite tactic of the left is to wait until all the votes are in and then in their strongholds like Fairfax county to suddenly find just enough votes to win. It’s been done in Chicago forever.
