Alright unsurprisingly one of you have asked me for my view on whether or not the jury being out for this period of time is bad for Rittenhouse? My view is that it’s not and I’ll tell you why. First off this was a ten day trial and that’s pretty long as things go and there are 5 charges to consider and the last thing they want to do is to appear not to have thoroughly considered all the evidence.

Now the judge should have sequestered the jury because there is no way that they will not know what’s going on in Kenosha. It is all that is being talked about and they know about the protests outside, which apparently could be heard inside the courthouse, and so they have to take into account what will happen to them and Kenosha based on their verdict.

Think “A Time To Kill” a great movie and an even greater book. As an aside it was John Grisham’s first novel but was not hyped until after “The Firm” because apparently it wasn’t considered as exciting. Really, it opens up with a 13 year old black girl being tied spread eagled naked and continuously raped by two white redneck KKK members. Yeah that’s boring compared to graduating from Harvard law.

Anyway, the jury is making sure that they look at everything and they are also concerned with their own safety because they weren’t sequestered. There is one black man on the jury and he may be really scared that he will face physical danger if he doesn’t give BLM the verdict they want.

So why do I think you don’t need to be worried is because the judge has in front of him a new motion for a mistrial with prejudice and there was already a similar motion earlier based on prosecutorial misconduct and the amount is overwhelming. I have mentioned previously that the prosecution withheld exculpatory evidence which they are required to turn over to the defense as established by Brady v. Maryland more than 50 years ago. They didn’t do it and now after the testimony ended over the weekend they gave the defense a video taken apparently by an FBI drone in HD. They had previously given them a fuzzy blurry copy. Think the difference between watching old tv and watching present day tv except that it wasn’t even as good as old time tv. I saw it on Eric Bolling today and he showed what the defense was given above the longer hd version had and it was truly night and day.

I think that the judge has not ruled because he hopes the jury will do the right thing, but if they don’t he will. He’s clearly pissed off about the prosecutorial misconduct and the media fake news.
