The question arises of what the remedy would be if the Supremes agree with Texas. There are several options. They could require the states being sued to conduct a new election. I think this is an option that they will never choose because it would result in the election not being determined until after the transition on January 20.
They could also determine that the electoral votes of those states are invalid and can’t be counted which would mean the election would be sent to House of Representatives because neither candidate got the required 270 votes and that would result in Trump winning because each state gets one vote and the republicans have the majority of representatives in the majority of states. I don’t believe that they will do that either because it would in effect mean that were choosing the president.
So what is the other option? They could throw it back to the constitutionally empowered state legislators to determine which slate of electors should be certified. Keep in mind that the Republicans control both houses in each of states at issue. The question then becomes how will they vote. Much has been made about the spineless refusal of these state legislatures to do their duty and refuse certify the fraud in their states. However I believe that when forced to stand up and be counted, they will remember who elected them and if they want to keep their seats they will vote republican or face the wrath of the voters If they vote for their constituency, and their political life, Trump wins.
